Terms of Service — LabsFive for Doctors
Last updated: August 11, 2026 · Effective: August 11, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("Physician," "you," or "your") and LabsFive ("LabsFive," "we," "us," or "our") governing your access to and use of the LabsFive for Doctors portal at app.labsfive.com (the "Portal").
By creating a Portal account, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and our Professional Use Disclaimer, all of which are incorporated herein by reference.
These Terms are separate from and do not replace the Terms of Service that govern LabsFive's direct-to-consumer service at LabsFive.com. If you do not agree to these Terms, do not create or use a Portal account.
2. Description of Service
The Portal is a subscription and credit-based professional tool that allows licensed healthcare providers to submit a patient's laboratory results and receive an AI-assisted, plain-language draft explanation of those results, formatted as a downloadable report, for the Physician's own use in their practice.
What the Portal is:
- A professional productivity tool that drafts a plain-language explanation of laboratory values for you to review and, at your discretion, share with your patient
- A dashboard for organizing and retrieving the reports you have generated
What the Portal is not:
- A diagnostic tool, a clinical decision-support system intended to direct your medical judgment, or a substitute for your own review of the underlying lab document
- A guarantee of clinical accuracy — see Professional Use Disclaimer
- A party to the relationship between you and your patient
3. Eligibility & Account Approval
To use the Portal, you represent and warrant that:
- You are a licensed healthcare professional in good standing in your jurisdiction, or you are creating and using this account under the direct authorization and supervision of one
- You are at least 18 years of age and have the legal capacity to enter into a binding contract
- All information you provide during registration is accurate and current
- You will only submit patient data that you are authorized to process, consistent with your own professional and legal obligations
Manual account approval. New accounts may use their initial free credits immediately, but a LabsFive administrator manually reviews every account before it is permitted to purchase a subscription or additional credits. LabsFive may approve, reject, or later suspend any account at its sole discretion, including on the basis of an inability to verify professional licensure.
4. Professional Responsibility
THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.
The Portal produces an AI-generated draft. You, and only you, are the licensed professional responsible for every report you choose to deliver to a patient. Before sharing any report generated through the Portal with a patient, you are responsible for:
- Reviewing the report's content against the original lab document and your own clinical knowledge
- Confirming its accuracy, completeness, and appropriateness for that specific patient's clinical context
- Exercising your own independent professional judgment about whether, how, and when to share it
LabsFive does not review, approve, or take clinical responsibility for any report before or after you deliver it to a patient. Your use of the Portal does not transfer, share, or reduce your professional responsibility to your patient in any way. See the full Professional Use Disclaimer for further detail — it is incorporated into these Terms by reference and, in the event of any conflict on matters of clinical responsibility, controls over this section.
5. Acceptable Use
You agree not to:
- Submit a patient's data without the appropriate authorization under your own professional and legal obligations
- Share your account credentials with any other individual, or use the Portal on behalf of a colleague who does not have their own account
- Deliver a report to a patient without independently reviewing it as described in Section 4
- Use the Portal for any purpose other than generating reports for your own patients in the course of your professional practice
- Attempt to reverse-engineer, scrape, or extract the underlying prompts, methodology, or algorithms used by the Portal
- Use automated tools, bots, or scripts to interact with the Portal
- Attempt to gain unauthorized access to any other physician's account or data
LabsFive reserves the right to suspend or terminate any account found in violation of these provisions, without refund.
6. Credits, Subscriptions & Billing
6.1 Free Credits
Every new account receives a fixed number of free credits upon registration. Free credits do not renew, do not expire on a schedule, and are granted once per account.
6.2 Subscription Plans
Paid subscription plans (currently offered as "Básico" and "Pro") bill monthly in advance and grant a fixed number of credits at the start of each billing cycle. Unused credits from a prior cycle do not carry over unless explicitly stated otherwise at the time of purchase.
6.3 One Credit, One Report
Each report generation consumes exactly one credit, regardless of report type. A credit is deducted at the moment you submit a report request, before generation completes, and is not returned if you are dissatisfied with the resulting content — see Section 7 and the full Refund & Cancellation Policy for the one circumstance in which a credit is automatically returned (a failed generation).
6.4 Additional Credits
You may purchase additional credits at any time at the price displayed in your dashboard, billed as a one-time charge, in addition to any active subscription.
6.5 Payment Processing
All payments are processed by Stripe, Inc. By subscribing or purchasing credits, you authorize LabsFive to charge your payment method on the applicable schedule, and you agree to Stripe's own terms of service.
6.6 Price Changes
LabsFive may change subscription or credit pricing at any time. Changes take effect on your next billing cycle following notice; they never apply retroactively to a cycle already paid for.
7. Refunds & Cancellation
Refunds, cancellations, and what happens to your credits when you cancel are governed by our dedicated Refund & Cancellation Policy, incorporated into these Terms by reference. In summary: you may cancel your subscription at any time and retain access through the end of the paid period; a credit is automatically refunded if report generation fails on our end; credits are not refundable simply because you are unsatisfied with the AI-drafted content of a completed report.
8. Intellectual Property
8.1 Our Content
All content on the Portal and this site — including design, software, templates, and methodology — is owned by or licensed to LabsFive. You may not copy, reproduce, or create derivative works of it without our express written permission.
8.2 Generated Reports
You retain full ownership and control over the reports generated through your account and may use them in your practice, including sharing them with your patients, without restriction.
8.3 Submitted Patient Data
You (or your patient, depending on your jurisdiction's data ownership rules) retain ownership of the lab documents and patient data you submit. You grant LabsFive a limited, non-exclusive license to process that data solely to generate the report you requested, terminating upon deletion of that data per our Privacy Policy.
9. Privacy
The collection, use, storage, and protection of data through the Portal — including the important distinction between your account data and your patients' data — is governed by our Privacy Policy, incorporated into these Terms by reference.
10. Disclaimers of Warranty
THE PORTAL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, LABSFIVE DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT AI-GENERATED REPORT CONTENT IS CLINICALLY ACCURATE, COMPLETE, OR APPROPRIATE FOR ANY SPECIFIC PATIENT WITHOUT YOUR OWN INDEPENDENT PROFESSIONAL REVIEW.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LABSFIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING ANY DAMAGES ARISING FROM A CLINICAL DECISION MADE OR A REPORT DELIVERED TO A PATIENT WITHOUT THE INDEPENDENT PROFESSIONAL REVIEW REQUIRED BY SECTION 4.
IN NO EVENT SHALL LABSFIVE'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU TO LABSFIVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless LabsFive from any claims, damages, or losses arising out of: your use of the Portal, your violation of these Terms, your submission of patient data without appropriate authorization, or any clinical decision or patient communication made without the independent professional review these Terms require of you.
13. Third-Party Services
The Portal integrates with third-party providers (Stripe, Anthropic, Netlify, Resend, Supabase) described in our Privacy Policy. LabsFive is not responsible for the actions or practices of these independent providers.
14. Termination
LabsFive may suspend or terminate your account at any time for violation of these Terms, inability to verify professional eligibility, or suspected fraudulent activity. Upon termination, your access ceases immediately; provisions that by their nature should survive termination (including Sections 4, 8, 10, 11, and 12) do so.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the applicable jurisdiction. Before initiating any formal dispute, you agree to first contact legal@labsfive.com and attempt informal resolution. Disputes that cannot be resolved informally are subject to binding individual arbitration, except where either party seeks injunctive relief to protect intellectual property rights.
16. Changes to These Terms
We may modify these Terms at any time. Material changes will be reflected in the "Last Updated" date above and, where they materially affect your rights, communicated by email to active accounts. Continued use of the Portal after a change constitutes acceptance of the revised Terms.
