These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and LabsFive ("LabsFive," "we," "us," or "our") governing your access to and use of our website at LabsFive.com and our lab result interpretation service (collectively, the "Service").

By accessing our website, submitting any information, or purchasing our Service, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must immediately discontinue use of our Service. Your continued use of the Service following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

LabsFive provides an AI-powered educational interpretation service for clinical laboratory results. Upon submission of your lab report and payment of the applicable fee, we generate a detailed, visual, plain-language interpretation of the biomarker values contained in your submitted document and deliver it to your provided email address in PDF format within the stated delivery timeframe.

What LabsFive is:

• An educational tool designed to help individuals better understand the content of their clinical lab results
• A service that contextualizes lab values against established clinical reference ranges
• A platform that provides general health and lifestyle information associated with specific biomarkers

What LabsFive is not:

• A medical practice, clinic, hospital, or licensed healthcare provider
• A diagnostic service — we do not diagnose, treat, or manage any medical condition
• A substitute for professional medical advice, examination, or treatment
• A prescription service — we never recommend, suggest, or endorse any medication or medical procedure

The scope of our Service is strictly limited to the educational interpretation of the specific lab document you submit. We do not review your medical history, consider your current medications, evaluate your symptoms, or account for any clinical context beyond what is contained in the uploaded document.

3. Medical Disclaimer

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

The interpretations, information, and content provided by LabsFive through its Service are intended solely for general educational and informational purposes. Nothing in our Service constitutes, or should be construed as, the practice of medicine, nursing, pharmacy, or any other licensed healthcare profession.

LabsFive expressly does not:

• Diagnose any disease, disorder, or medical condition
• Recommend or prescribe any medication, supplement, or treatment
• Replace, supplement, or delay your consultation with a qualified healthcare professional
• Provide personalized medical advice based on your individual clinical circumstances

Your lab results must always be reviewed and interpreted by a licensed medical professional who has access to your complete medical history, symptoms, current medications, and clinical context. The AI-generated interpretation you receive from LabsFive is a starting point for conversation with your doctor — not a conclusion.

If you are experiencing a medical emergency, call your local emergency services immediately. Do not rely on LabsFive for emergency health decisions.

LabsFive assumes no liability for any health decisions made based on the content of our interpretations. You use this Service entirely at your own risk in this regard.

4. Eligibility

To use our Service, you must meet all of the following requirements:

• Be at least 18 years of age. Our Service is not intended for minors and we do not knowingly provide services to individuals under 18.
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Be submitting lab results that belong to you personally. You may not submit the lab results of another individual without their explicit written consent and without being their legally authorized representative.
• Provide accurate, truthful, and complete information when submitting your lab documents and personal details.
• Not be located in a jurisdiction where use of our Service is prohibited by applicable law.

By using our Service, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet these requirements, you must not use our Service.

5. User Responsibilities

You are solely responsible for:

5.1 Accuracy of Submitted Information

Providing a correct and functional email address to which your report will be delivered. LabsFive is not responsible for undelivered reports resulting from an incorrect email address provided by you. Providing accurate personal details including your age and biological sex, which are used to contextualize your lab interpretation. Submitting a clear, legible, and complete copy of your lab document. Illegible or incomplete submissions may result in an incomplete interpretation, for which LabsFive is not liable.

5.2 Health Decisions

All decisions related to your health, including decisions made in response to information contained in your LabsFive report, are made entirely at your own risk and discretion. You are responsible for consulting a qualified healthcare professional before making any changes to your diet, lifestyle, medications, or medical care.

5.3 Account Security

If account functionality is made available in the future, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

6. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You expressly agree not to:

• Submit lab documents belonging to another person without their explicit written consent and your legal authorization to do so
• Upload fraudulent, altered, fabricated, or misleading lab documents
• Use the Service for any commercial purpose, including reselling, redistributing, or repurposing our interpretations without our express written permission
• Attempt to reverse-engineer, copy, reproduce, or extract the underlying methodology, prompts, or algorithms used to generate our interpretations
• Use automated tools, bots, scrapers, or scripts to access or interact with our Service
• Attempt to gain unauthorized access to any portion of our systems, servers, or infrastructure
• Use our Service in any manner that could damage, disable, overburden, or impair our systems
• Violate any applicable local, national, or international law or regulation in connection with your use of our Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

LabsFive reserves the right to refuse service, cancel orders, and terminate access for any user found to be in violation of these Acceptable Use provisions, without refund.

7. Payment Terms

7.1 Pricing

The current price for one lab interpretation report is displayed on our website at the time of purchase. LabsFive reserves the right to change its pricing at any time, with changes taking effect immediately upon posting to the website. Price changes will not affect orders already submitted and paid.

7.2 Payment Processing

All payments are processed securely by Stripe, Inc. By completing a purchase, you agree to Stripe's Terms of Service and authorize the charge to your selected payment method. LabsFive does not store, access, or retain any payment card information.

7.3 Currency

All prices are listed and charged in United States Dollars (USD). If your payment method is denominated in another currency, your bank or card issuer may apply a foreign exchange fee or conversion rate, for which LabsFive is not responsible.

7.4 Taxes

You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction in connection with your purchase. LabsFive may be required to collect sales tax in certain jurisdictions and will do so as required by law.

7.5 Failed Payments

If your payment fails or is declined, your order will not be processed and no report will be generated. Please ensure your payment information is accurate before submitting.

8. Refund Policy

8.1 Standard Policy

Due to the digital and personalized nature of our Service, all sales are generally final once the interpretation process has begun. We invest significant computational and review resources in generating your report immediately upon payment confirmation.

8.2 Eligibility for Refund

We will issue a full refund in the following circumstances:

• Your report was not delivered to your email within 8 hours of payment confirmation despite a correct email address having been provided
• The report delivered is materially incomplete — for example, fewer than 50% of the biomarkers in your submitted document were interpreted
• A technical error on our part resulted in a corrupted, blank, or unreadable report being delivered

8.3 How to Request a Refund

Contact us at support@labsfive.com within 24 hours of receiving your report (or within 24 hours of the expected delivery window if no report was received). Include your full name, email address used at purchase, and a description of the issue. We will review and respond within 2 business days.

8.4 Discretionary Refunds

Outside of the above circumstances, refunds are granted at the sole discretion of LabsFive. We are committed to customer satisfaction and will evaluate each case fairly. We will not, however, issue refunds based on disagreement with the content of a medically accurate interpretation.

9. Intellectual Property

9.1 Our Content

All content on the LabsFive website — including but not limited to text, design, graphics, logos, report templates, methodology, and software — is owned by or licensed to LabsFive and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any LabsFive content without our express written permission.

9.2 Your Report

The personalized interpretation report generated for you is provided for your personal, non-commercial use only. You may share your report with your healthcare provider. You may not resell, publish, or commercially distribute your report.

9.3 Your Submitted Data

You retain full ownership of the lab documents you submit to us. By submitting them, you grant LabsFive a limited, non-exclusive license to process and analyze that data solely for the purpose of generating your interpretation. This license terminates upon deletion of your data in accordance with our Privacy Policy.

9.4 Feedback

If you provide feedback, suggestions, or ideas about our Service, you grant LabsFive the right to use that feedback without restriction or compensation to you.

10. Privacy

Your privacy is fundamental to how we built LabsFive. The collection, use, storage, and protection of your personal and health data is governed exclusively by our Privacy Policy, available at LabsFive.com/privacy, which is incorporated into these Terms by reference.

By using our Service, you consent to the data practices described in our Privacy Policy. If you do not agree with our Privacy Policy, you must not use our Service.

11. Disclaimers of Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LABSFIVE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY INTERPRETATION OR CONTENT
• WARRANTIES THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS

LABSFIVE DOES NOT WARRANT THAT THE AI-GENERATED INTERPRETATIONS ARE MEDICALLY ACCURATE, COMPLETE, OR APPLICABLE TO YOUR INDIVIDUAL HEALTH CIRCUMSTANCES. LAB INTERPRETATION IS AN INHERENTLY COMPLEX CLINICAL FUNCTION THAT REQUIRES CONSIDERATION OF FACTORS BEYOND THE SCOPE OF THIS SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LABSFIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL
• DAMAGES ARISING FROM YOUR RELIANCE ON THE CONTENT OF ANY REPORT GENERATED BY OUR SERVICE
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR SUBMISSIONS
• DAMAGES ARISING FROM ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE

IN NO EVENT SHALL LABSFIVE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO LABSFIVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless LabsFive and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Service
• Your violation of these Terms
• Your submission of inaccurate, fraudulent, or unauthorized data
• Any health decision you make based on content provided by our Service
• Your violation of any applicable law or the rights of any third party

LabsFive reserves the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of such matter.

14. Third-Party Services

Our Service integrates with third-party providers to function, including Stripe for payment processing, Anthropic for AI processing, and email delivery providers. These third parties operate under their own terms of service and privacy policies, which are independent of LabsFive.

LabsFive is not responsible for the actions, content, privacy practices, or terms of any third-party service. Your use of third-party services connected to LabsFive is governed by their respective agreements.

Our website may contain links to third-party websites for informational purposes. These links do not constitute an endorsement. LabsFive has no control over and assumes no responsibility for the content or practices of any linked third-party website.

15. Termination

LabsFive reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Submission of fraudulent or unauthorized data
• Behavior that is abusive, threatening, or harmful toward our team
• Suspected fraudulent payment activity

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including but not limited to Sections 3, 9, 11, 12, 13, and 16 — shall survive termination.

If your access is terminated due to your violation of these Terms, you will not be entitled to a refund of any amounts paid.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.

16.2 Informal Resolution

Before initiating any formal dispute process, you agree to contact us at legal@labsfive.com and attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issue within 30 days.

16.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration rather than in court, except that you may bring claims in small claims court if they qualify. Arbitration is conducted on an individual basis — class actions and class arbitrations are not permitted.

16.4 Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

17. Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect. The invalidity of one provision does not affect the validity of any other provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and LabsFive with respect to the subject matter herein and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Service.

No waiver by LabsFive of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by LabsFive to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" and "Effective" dates at the top of this page
• Post a prominent notice on our website homepage for a minimum of 30 days
• Send an email notification to users who have transacted with us in the prior 90 days

Material changes will not apply retroactively to disputes arising before the effective date of the change. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
